General Terms and Conditions (GTC)

§ 1 Scope

These General Terms and Conditions (GTC) apply to all orders placed through our online shop www.apollosolarenergy.de by consumers in accordance with Section 13 of the German Civil Code (BGB). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

§ 2 Contracting parties and contact

§ 3 Conclusion of contract

The product presentations in the online shop do not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By clicking the “Buy now” button you submit a binding offer to conclude a purchase contract.
Confirmation of receipt of your order will be sent by email immediately after you submit it. The purchase contract is concluded upon dispatch of a separate order confirmation or delivery of the goods.

§ 4 Prices and payment conditions

All prices are in euros including VAT plus shipping costs.
The following payment methods are available:
  • PayPal
  • Credit card (Visa, Mastercard)
  • Instant bank transfer
  • SEPA direct debit
  • Prepayment by bank transfer
Unless otherwise agreed, the invoice amount is due for payment immediately.

§ 5 Delivery, shipping, transfer of risk

Delivery will be made to the delivery address you specify within Germany and the EU.
Delivery time : 3–7 business days (unless otherwise stated). Shipping providers : DHL, DPD, freight forwarder (depending on product size and weight).
The risk passes to the customer upon delivery of the goods.

§ 6 Retention of title

The delivered goods remain our property until full payment has been made.

§ 7 Right of withdrawal

Consumers have a right of withdrawal pursuant to Section 355 of the German Civil Code (BGB). The withdrawal period is 14 days from receipt of the goods. All details can be found in our separate cancellation policy . Note pursuant to Section 357, Paragraph 6 of the German Civil Code (BGB) : In the event of a withdrawal, you will bear the direct costs of the return shipment.

§ 8 Transport damage

If goods are delivered with obvious transport damage, please report such damage to the deliverer as soon as possible and contact us immediately.
Your statutory warranty rights remain unaffected.

§ 9 Warranty and Guarantee

The statutory liability for defects according to §§ 434 ff. BGB applies.
Note for electrical devices and batteries : Please note that improper commissioning or incorrect installation by unauthorized personnel may lead to the exclusion of warranty claims.
Any additional manufacturer warranties offered are in addition to the statutory rights and only subject to the respective warranty conditions.

§ 10 Liability

We are fully liable for intent and gross negligence.
We are only liable for simple negligence in the event of a breach of essential contractual obligations (cardinal obligations) and limited to foreseeable damage.
We are not liable for indirect damages, lost profits or consequential damages unless required by law (e.g. Product Liability Act).

§ 11 Data Protection

Information on the processing of your personal data can be found in our privacy policy .

§ 12 Applicable law and place of jurisdiction

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a merchant, the exclusive place of jurisdiction is Frankfurt am Main.

§ 13 Final provisions

Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
Ineffective clauses shall be replaced by the statutory provisions.
