General Terms and Conditions (GTC) for Consumers

§1 Scope

(1) These General Terms and Conditions (GTC) apply to all contracts for the delivery of goods between

(hereinafter "Seller")
and consumers within the meaning of §13 BGB (German Civil Code).
(2) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.
(3) Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity in writing.

§2 Offer and Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.
(2) By placing an order, the customer submits a binding offer to conclude a purchase contract.
(3) The contract is concluded by
  • an order confirmation by e-mail
  • or by dispatch of the goods
(4) The seller reserves the right to refuse orders without stating reasons.

§3 Prices and Payment Terms

(1) All prices include statutory VAT.
(2) In addition to the stated prices, shipping costs may apply.
(3) The following payment methods are accepted:
  • Credit card
  • PayPal
  • Bank transfer
  • other payment methods offered in the online shop.
(4) The purchase price is due immediately upon order, unless otherwise agreed.
(5) If the payment method "advance payment" is selected, the goods will only be dispatched after receipt of payment.

§4 Delivery and Shipping

(1) Delivery will be made to the delivery address specified by the customer.
(2) Delivery times are stated in the respective offer.
(3) If an ordered product is not available, the customer will be informed immediately.
(4) If delivery is not possible due to force majeure or delivery problems with the upstream supplier, the seller is entitled to withdraw from the contract. Any payments already made will be refunded immediately.
(5) Partial deliveries are permissible, provided they are reasonable for the customer.
(6) For bulky or particularly heavy products (e.g., energy storage systems or solar modules), delivery may be made by a freight forwarder. In this case, the customer will be informed of the delivery in advance.

§5 Damage in Transit

(1) If goods are delivered with obvious transport damage, the customer is requested to complain about this to the deliverer immediately and to inform the seller.
(2) Failure to complain or make contact has no consequences for the customer's statutory warranty rights.

§6 Retention of Title

The goods remain the property of the seller until full payment has been received.

§7 Warranty

(1) The statutory warranty rights apply.
(2) The statutory warranty period is 24 months from the delivery of the goods.
(3) For certain products, in particular energy storage systems, solar modules, and accessories, a manufacturer's warranty may also exist.
(4) Processing within the framework of a manufacturer's warranty takes place in accordance with the respective warranty conditions of the manufacturer. These may differ from the statutory warranty rights and do not restrict them.

§8 Liability

In addition, the following applies:
(1) The statutory right of withdrawal remains unaffected by this.
(2) Returns outside the statutory right of withdrawal are made exclusively according to the conditions defined in the return policy.
(3) For returns, additional transport costs may arise depending on the product type (e.g., bulky goods, battery systems).

§9 Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days.

§12 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

The seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§13 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless this is opposed by mandatory consumer protection regulations.

§14 Final Provisions

Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
